The Law Offices of Jed Silverman is currently representing Julian Carmona,
a man who was arrested and charged with
aggravated assault after allegedly pointing a gun at an off-duty Houston police officer.
Surveillance video recorded at the scene, however, tells a different story.
The video shows that Mr. Carmona pulled into a gas station parking lot
at the same time as the officer. A gun accidentally fell from the vehicle
when he opened the door, and he quickly picked it up and put it back.
The officer then stepped out of his vehicle pointing his own weapon. Carmona
put his hands up, briefly tried to reach for his concealed carry permit,
and quickly put his hands back up. He was then ordered to the ground and
arrested while his two children looked on from the car. The video does
not show any evidence at all that Carmona ever pointed a gun at the officer.
“It absolutely, unequivocally does not happen,” says Mr. Silverman.
“The officer stated that in the police report that my client pointed
a gun at him and it ain’t even close.”
Another surveillance video reveals that the officer had stopped at the
gas station market to buy beer. Although he was off-duty, it is against
Police Department policy for officers to purchase alcohol while in uniform.
The Department is investigating.
