What Are The Penalties Of Cocaine Charges

|

Crack Cocaine is one of the most heavily penalized drugs in the state of Texas. Prosecutors will act quickly to bring these charges against anyone who they suspect may violate the health and safety laws established in the state.

Penalties

The penalties for cocaine-related charges depend completely on the situation and the nature of the offense. For example, possession of the drug warrants different punishments than trafficking or distributing it.

Possession: Under theTtexas Health & Saftey code, less than 1 grams is a state jail felony; 1-4 grams is a 3rd-degree felony; 4-200 grams is a 2nd-degree felony; 200-400 grams is a 1st-degree felony, and lastly 400 grams and over can be 10 years to life at Texas Dept. of Criminal Justice institution and/or $100,000.

Trafficking: The punishments for cocaine trafficking can be anywhere from 180 days to two years in jail. It can also include a fine of up to $10,000 for a state jail felony, to life in the Texas Department of Criminal Justice or a term of 15 to 99 years in prison and/or a fine of not more than $250,000 for the heaviest first-degree felony. The harshness of the sentence imposed depends on how much of the drug is being trafficked.
